You represent and warrant that You are at least 16 years old. The Company does not permit those under 16 to use the Service. Because the Service does not require account registration and does not verify identity, this representation is Your sole assurance of age, and the Company has no independent means of confirming it.
Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Market AirPort Privacy Policy, which describes the Company's approach to data (including that the Company does not collect personal data). The Service permits You to access and use a peer-to-peer marketplace without creating an account or providing registration information. Because no accounts exist, You are solely responsible for any Device, connection, and cryptographic keys or credentials You use to access and transact through the Service, and for maintaining their confidentiality and security. The Company has no ability to recover access, Content, or transaction history on Your behalf.
The Service allows You to post listings and other Content in order to buy, sell, or exchange goods or services directly with other Users. You are solely responsible for the Content You post, including its legality, accuracy, and appropriateness, and for any transaction You enter into with another User.
Because the Service is end-to-end encrypted and the Company does not collect, access, or store Content, You retain full responsibility for Your Content, and the Company neither reviews nor has the ability to review Content before or after it is posted or exchanged.
You may not use the Service to post, transmit, or exchange Content that:
Except as expressly restricted above, the Company supports open, lawful expression on the Service and does not otherwise restrict the content of lawful communications between Users.
Important limitation on enforcement: Because the Service is end-to-end encrypted and the Company does not access, monitor, log, or store Content, the Company has no technical ability to review, detect, or verify compliance with the restrictions in this Section. Compliance depends entirely on Users. The Company reserves the right to restrict or deny access to the Service to any User it becomes aware of violating these restrictions, to the extent technically possible given the Service's architecture, but makes no representation that it monitors, moderates, or is able to identify violations.
You may not copy, export, repost, or otherwise share Content obtained through the Service on or to any outside platform, website, or service. This restriction applies regardless of whether You authored the Content or received it from another User.
The Company does not back up, store, or retain Content, consistent with its no-data-collection architecture. You are solely responsible for maintaining any copy of Content You wish to preserve, independent of the Service.
The Company does not participate in, control, monitor, or claim any involvement in transactions, communications, listings, or other activity that occurs on or through the Service, regardless of its nature. The Company does not endorse, guarantee, or vouch for any User, listing, Content, or transaction. All transactions and interactions on the Service occur solely between Users, at their own risk.
Payments for goods or services exchanged through the Service are made using cryptocurrency, directly between Users. The Company is not a party to, and does not process, custody, hold, guarantee, insure, or facilitate the reversal of, any payment or transaction. You are solely responsible for the accuracy of payment details, the security of Your wallet and keys, and the outcome of any transaction. The Company assumes no liability for lost, misdirected, fraudulent, or irreversible cryptocurrency transactions. The Service itself, and its original content, features, and functionality (excluding Content provided by Users), including the "Market AirPort" name and any associated branding, are and will remain the exclusive property of the Company. The Company's trademarks may not be used in connection with any product or service without prior written consent.
The Company does not host, store, or claim ownership of User Content, and accordingly does not act as a repository of User Content for purposes of intellectual property infringement claims. Disputes regarding the legality or ownership of Content exchanged between Users are solely between the Users involved.
You assign all rights, title, and interest in any Feedback You provide to the Company. If such assignment is ineffective for any reason, You grant the Company a non-exclusive, perpetual, irrevocable, royalty-free, worldwide right and license to use, reproduce, disclose, sublicense, distribute, modify, and exploit such Feedback without restriction.
The Service may contain links to third-party websites or services not owned or controlled by the Company. The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We strongly advise You to review the terms and privacy policies of any third-party site You visit.
Because the Service does not use accounts, the Company's ability to "terminate" access is limited to technical measures available to it (for example, restricting access from a given Device or connection where technically feasible). The Company reserves the right to restrict or deny access to the Service, without prior notice, for any reason, including breach of these Terms. If You wish to stop using the Service, You may simply discontinue accessing it.
To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including but not limited to damages for loss of profits, loss of data, business interruption, personal injury, or loss of privacy) arising out of or in any way related to Your use of, or inability to use, the Service, any transaction conducted through the Service, or any Content, even if the Company has been advised of the possibility of such damages.
The Company's total liability for any claim arising out of or relating to these Terms or the Service shall not exceed 1,000 USD, as the Company does not process payments for use of the Service itself.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In such jurisdictions, the limitations in this Section apply to the greatest extent permitted by law.
The Service is provided "AS IS" and "AS AVAILABLE," with all faults, and without warranty of any kind. To the maximum extent permitted by applicable law, the Company disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. The Company makes no representation that the Service will be uninterrupted, error-free, secure, or free of harmful components, or that any transaction or Content exchanged through the Service will be lawful, accurate, or as represented by the User providing it.
The Service is accessible to Users internationally. The Company makes no representation that the Service, or Content exchanged through it, is appropriate, legal, or available for use in every jurisdiction. If You access the Service from outside Switzerland, You do so on Your own initiative and are solely responsible for compliance with the laws of Your jurisdiction, including any laws governing the goods or services You buy, sell, or exchange through the Service. Where the mandatory consumer protection or other laws of Your country of residence cannot be excluded or overridden by agreement, this Section does not limit the protections those laws provide You.
You represent and warrant that You are not located in, or a resident of, any country or region subject to comprehensive international sanctions (including sanctions regimes maintained by Switzerland, the European Union, the United Nations, the United States, and the United Kingdom), and that You are not listed on any applicable sanctions or restricted-party list.
These Terms and Your use of the Service shall be governed by the laws of Switzerland, excluding its conflict of law rules, regardless of Your country of residence. The courts of Geneva, Switzerland shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except where the mandatory consumer protection or jurisdictional law of Your country of residence requires otherwise.
If You have a concern or dispute about the Service, You agree to first attempt to resolve the dispute informally by contacting the Company.
If any provision of these Terms is held unenforceable or invalid, that provision will be changed and interpreted to accomplish its objectives to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
Except as provided herein, the failure to exercise a right or require performance of an obligation under these Terms shall not affect a party's ability to exercise that right or require that performance at any later time, nor shall a waiver of a breach constitute a waiver of any subsequent breach.
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will make reasonable efforts to provide at least 30 days' notice before the new terms take effect. By continuing to access or use the Service after revisions become effective, You agree to be bound by the revised Terms.
